FreedomWorks Highlights Sen. Cruz's Constitutional Amendment To Prevent Court Packing as 'Bill of the Month'

WASHINGTON, D.C. - U.S. Sen. Ted Cruz (R-Texas) today issued the following statement after FreedomWorks named his "Keep Nine" Constitutional amendment to prevent the expansion or contraction of the Supreme Court as their bill of the month for December: 

"Democrats want to pack the Supreme Court with liberal justices who will undermine our fundamental freedoms: our religious liberty, our freedom of speech, and our Second Amendment. My constitutional amendment will stop them from changing the number of justices on the bench and preserve the independence of our judiciary. I am honored that FreedomWorks is highlighting our efforts in the Senate to protect one of the foundations of our democratic system."

"Sen. Ted Cruz continues to be a champion for constitutional conservatism. His recent ‘Keep Nine' Amendment seeks to create a constitutional backstop against ‘court packing' by enshrining the number of Supreme Court justices at nine. With so much talk on the left of radically changing the structure of our nation's highest court for political purposes, this is simply essential to protecting our institutions." 

BACKGROUND:

Over the last few months, it's become clear that, should Chuck Schumer become Senate Majority leader, Democrats will move to pack the Supreme Court, advance their radical agenda, and entrench their power for generations to come.

Senate Democrats have repeatedly made their intentions to pack the court known. For example:

  • Sen. Ed Markey tweeted just hours after Justice Ginsburg's passing, "Mitch McConnell set the precedent. No Supreme Court vacancies filled in an election year. If he violates it, when Democrats control the Senate in the next Congress, we must abolish the filibuster and expand the Supreme Court."
  • Sen. Mazie Hirono, Ranking Member of the Subcommittee on the Constitution, signaled support for packing the Supreme Court, calling Court packing "long-overdue court reform."
  • Sen. Kamala Harris voiced her openness to expanding the Supreme Court saying, "We are on the verge of a crisis of confidence in the Supreme Court [...] We have to take this challenge head on, and everything is on the table to do that."
  • Sen. Elizabeth Warren voiced her support for expanding the Court while perfectly underlining the need for Sen. Cruz's legislation saying, "I'm open. [...] Actually, I mean, we could. [...] Look, there are a lot of different ways to do it. The number of people on the Supreme Court is not constitutionally constricted."

In response to the real threat to the Supreme Court posed by Democrats, Sen. Cruz in October introduced two legislative proposals in the Senate - including the "Keep Nine" Constitutional Amendment - to maintain the number of justices on the bench, preserve the integrity and independence of the federal judiciary, and protect Americans' constitutional liberties.
